The general framework governing Italian citizenship is Law 91 of 5 February 1992 as implemented by DPR 572 of 12/10/1993 and DPR 362 of 04/18/1994, and Law n. 94 of 5 July 2009, which, unlike the previous law, re-evaluates the importance of individual desire in the gain or loss of citizenship and acknowledges the right to hold citizenship in more than one country, except in the case of the various provisions of international agreements.

Generally speaking, the Italian law now in force allows to hold another citizenship in addition to the Italian one. The statutes on citizenship concern:

- Those who were born Italian citizens but lost their citizenship and now wish to reacquire it;

- descendants of Italian citizens who are eligible for and wish to have their Italian citizenship recognized;

- foreigners who intend to acquire Italian nationality (married with an Italian  citizen for at least 3 years);

The above cases are governed by different articles of the law.

As a general rule, the Law recognizes the possibility to acquire the Italian citizenship to individuals born from a father of Italian citizenship (or from a father who had not yet lost or renounced the Italian citizenship when such individual was born). After the entry into force of the Constitution of 1948, the same criteria apply to those born after January 1, 1948 from a mother of Italian citizenship.
