Divorce

In order to register in Italy a divorce sentence occurred in the territorial jurisdiction of this Consulate General (Arkansas, Louisiana, Oklahoma and Texas), the following documents must be provided by mail to this Office:

1. Certified copy of the full divorce decree/sentence/judgment issued by the Court and  duly legalized with Apostille. The Apostille is issued by the competent Secretary of State – click here

2. Declaration issued by the District Judge or the Court Clerk that no appeal was filed within the time allowed by State law, duly legalized with Apostille. The Apostille is issued by the competent Secretary of State – see above.

3. Full translation into Italian language of all the above documents, with the exception of the Apostille (see list of translators).

4. Affidavit duly filled out and signed -Legge 4/01/68 n. 15 artt. 4 e 20 (vedasi modulo).

5. Form to request the registration of the Divorce Decree duly filled out and signed. Click here Richiesta di Trascrizione di Certificato di Divorzio.

6. Copy of the applicant's valid passport (the Italian one if available).

 

Italian citizens not registered with this Consulate and resident in Italy can request to proceed to the registration at this Consulate.

Italian citizens registered with another Consulate will have to submit the above mentioned documents to the Consulate where they are registered.
