<\/a>Legal Guidelines<\/h3>\n

The legislative changes introduced by Decree-Law 36\/2025, as converted by <\/strong>Law 74\/2025<\/strong><\/a>, have introduced significant limitations<\/u> on the transmission of Italian citizenships to minors born abroad. <\/strong>The new full text of Law 91\/1992<\/a> is available.<\/p>\n

Under the new law, minor children<\/u> born abroad to Italian citizens <\/strong>may fall into one of the following three categories:<\/p>\n

    \n
  1. May be recognized Italian citizens from the day of birth <\/strong>(also known as Citizenship by Descent, Citizenship Jure Sanguinis<\/strong>, Citizenship by Birth<\/strong>)<\/li>\n
  2. May, in limited cases, acquire<\/strong> Italian citizenship from the day following the parents\u2019 signing of the Declaration of Intent (<\/strong>also known as Citizenship by Beneficio di Legge) <\/strong><\/li>\n
  3. Cannot obtain Italian Citizenship<\/strong><\/li>\n<\/ol>\n

    <\/a>Citizenship by Descent for minors born abroad<\/h4>\n

    Minor children born abroad to Italian citizen may be\u00a0recognized\u00a0as Italian Citizens by Descent<\/u><\/strong> if\u00a0they fall into one of the following cases:<\/p>\n

    CASE A1<\/strong>\u00a0\u2013 On\u00a0the day of the minor\u2019s birth<\/u><\/strong>, one parent<\/u><\/strong> holds exclusively Italian citizenship<\/strong> (Art. 3-bis, comma 1, lettera C, Legge 91\/1992 <\/strong>applies).<\/strong><\/p>\n

    CASE A2<\/strong>\u00a0\u2013\u00a0On\u00a0the day of the minor\u2019s birth<\/u><\/strong>, one grandparent<\/u><\/strong> holds exclusively Italian citizenship<\/strong> (Art. 3-bis, comma 1, lettera C, Legge 91\/1992 <\/strong>applies).<\/strong><\/p>\n

    CASE B<\/strong>\u00a0\u2013 One parent<\/u><\/strong> has been resident<\/u> in Italy for at least two consecutive years<\/u> after<\/u><\/strong> acquiring Italian citizenship and before <\/u>the child\u2019s birth<\/strong> (Art. 3-bis, comma 1, lettera D, Legge 91\/1992 <\/strong>applies).<\/p>\n

    <\/a>Citizenship Jure Beneficio di Legge<\/h4>\n

    Minors born abroad may acquire Italian citizenships by Beneficio di Legge<\/u><\/strong> if at least one of their parents is Italian citizen by Descent<\/u><\/strong> (even if the parent holds another citizenship) and both<\/u><\/strong> parents<\/u> sign a Declaration of Intent<\/u> to acquire Italian citizenship:<\/p>\n
