{"id":7047,"date":"2025-09-10T13:53:08","date_gmt":"2025-09-10T18:53:08","guid":{"rendered":"https:\/\/conshouston.esteri.it\/?page_id=7047"},"modified":"2026-03-27T16:38:09","modified_gmt":"2026-03-27T21:38:09","slug":"7047-2","status":"publish","type":"page","link":"https:\/\/conshouston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza\/reacquirement-of-italian-citizenship\/7047-2\/","title":{"rendered":"Reacquisition of Italian citizenship art. 17, comma 1 della legge 91\/1992"},"content":{"rendered":"<p style=\"text-align: justify;\">The changes and amendments in regulations introduced by D.L. 36\/2025, signed into Law 74\/2025, allows former Italian citizens \u2014 including those residing abroad \u2014 to <strong>reacquire Italian citizenship<\/strong> by submitting a formal <strong>declaration of reacquisition<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>WHO MAY APPLY<\/strong><\/p>\n<p style=\"text-align: justify;\">The application for reacquisition may be submitted if <strong>both<\/strong> of the following requirements are met:<\/p>\n<ol style=\"text-align: justify;\">\n<li>The applicant is a former Italian citizen:\n<ul>\n<li>born in Italy, <strong>or<\/strong><\/li>\n<li>born abroad but has resided in Italy for <strong>at least two consecutive years<\/strong>;<\/li>\n<\/ul>\n<\/li>\n<li>The loss of Italian citizenship occurred <strong>no later than August 15, 1992<\/strong>, in one of the following cases:\n<ul>\n<li>the applicant <strong>voluntarily acquired<\/strong> a foreign citizenship NO LATER THAN August 15, 1992, establishing residence abroad (<em>naturalization<\/em>);<\/li>\n<li>the applicant <strong>acquired a foreign citizenship involuntarily<\/strong> and subsequently <strong>renounced<\/strong> Italian citizenship, establishing residence abroad;<\/li>\n<li>the applicant was a <strong>minor child living with a parent<\/strong> who acquired a foreign citizenship.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>THE LAW DOES NOT APPLY TO:<\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li>former Italian citizens born abroad who have <strong>never resided in Italy for at least two consecutive years<\/strong>;<\/li>\n<li>those who <strong>lost Italian citizenship after August 15, 1992<\/strong>, for any reason;<\/li>\n<li>those who lost citizenship in the cases provided under the <strong>Law No. 555\/1912 article 8, no. 3<\/strong>(i.e., those who, having accepted employment or military service with a foreign government, <strong>remained in such service despite a formal request by the Italian government to resign<\/strong> within a specified period);<\/li>\n<li>those who <strong>did not exercise the option<\/strong> provided under the <strong>Law No. 123\/1983 article 5, paragraph 2<\/strong>(i.e., minor children \u2013 including adopted children \u2013 of an Italian father or mother who, in cases of dual citizenship, were required to choose one citizenship within one year of reaching the age of majority).<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>APPLICATION PERIOD<\/strong><br \/>\nThe declaration of reacquisition may be submitted <strong>from July 1, 2025, to December 31, 2027<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>REQUIRED DOCUMENTATION<\/strong><\/p>\n<p><strong>This Consulate will ask for additional documentation if needed.<\/strong><\/p>\n<p><strong><em>For those who lost the Italian citizenship as adults:<\/em><\/strong><\/p>\n<ul>\n<li><a href=\"https:\/\/conshouston.esteri.it\/wp-content\/uploads\/2026\/03\/Form_riacquisto_17-1.pdf\">Form_riacquisto_art.17<\/a>;<\/li>\n<li>All <strong>passports<\/strong> (valid or expired);<\/li>\n<li>Last <strong>Italian passport<\/strong> (if owned);<\/li>\n<li>A <strong>valid ID<\/strong> (passport, State DL, State ID);<\/li>\n<li><strong>A<\/strong><strong> proof of residence<\/strong>\u00a0in this consular jurisdiction (recent utility bill, driver\u2019s license or State ID);<\/li>\n<li>Original <strong>Certificate of Naturalization<\/strong>, or equivalent documentation according to the local practice of the relevant foreign country (e.g., birth certificate accompanied by citizenship certification) indicating the date and reason of acquisition of foreign citizenship;<\/li>\n<li>Original\u00a0<strong>Estratto per Riassunto dell\u2019Atto di Nascita\u00a0<\/strong> issued by the Comune and not older than 6 months;<\/li>\n<li>Original\u00a0<strong>Copia Integrale dell\u2019Atto di Nascita<\/strong>\u00a0issued by the Comune and not older than 6 months;<\/li>\n<li><u>If\u00a0born abroad<\/u>, original\u00a0<strong>Certificato Storico di Residenza<\/strong>\u00a0issued by the Comune and not older than 6 months.<\/li>\n<li><strong>USPS Money Order<\/strong> for a total of: check Tabella Consolare, row \u201cRIACQUISTO CITTADINANZA, ART. 07C\u201d, column \u201cUSD Arrot\u201d. Be aware that the Tabella Consolare is updated every three months on January 1, April 1, July 1, October 1.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>For those who lost citizenship as minors:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>Original <strong>\u201cEstratto dell\u2019Atto di Nascita\u201d<\/strong> issued within the last six months:\n<ul>\n<li>if born in Italy, issued by the Municipality where the applicant was born;<\/li>\n<li>if born abroad, Birth Certificate with Apostille and translation into Italian (in the USA, a simple translation; in other countries, a certified translation);<\/li>\n<\/ul>\n<\/li>\n<li><u>If<\/u><u> born abroad,<\/u> <strong>Certificato Storico di Residenza<\/strong>\u00a0which shows the applicant\u2019s effective residence in Italy for a minimum of two consecutive years, issued by the Italian Municipality;<\/li>\n<li>Original <strong>extract of birth certificate<\/strong> of the parent who was a former Italian citizen;<\/li>\n<li><strong>Certificato storico di cittadinanza<\/strong>\u00a0of the parent who was a former citizen;<\/li>\n<li><strong>Certificate of Naturalization<\/strong> of the parent.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>APPOINTMENTS<\/strong><\/p>\n<p>The appointment to submit the\u00a0<strong>declaration of intent to reacquire Italian citizenship in person<\/strong><strong>,<\/strong> subject to payment of the applicable consular fee,<strong>\u00a0<\/strong><strong>must be scheduled exclusively by appointment<\/strong><strong>\u00a0<\/strong>through the<strong>\u00a0<\/strong><strong>Prenot@mi portal<\/strong>\u00a0(<a href=\"https:\/\/prenotami.esteri.it\/\">https:\/\/prenotami.esteri.it\/<\/a>) selecting the service \u201cReacquisition of the Italian Citizenship\u201d. During the reservation:<\/p>\n<ul>\n<li>The scan of the <strong><a href=\"https:\/\/conshouston.esteri.it\/wp-content\/uploads\/2026\/03\/Form_riacquisto_17-1.pdf\">Form_riacquisto_art.17<\/a><\/strong> (filled out and signed) must be <strong>uploaded<\/strong> at the time of reservation. Please be aware that the form should be in .pdf and not be larger than 1MB,<\/li>\n<\/ul>\n<p><strong>Appointments will not be moved for any reason<\/strong>. In case you will not be able to come to your appointment (or you do not have the complete documentation ready), the appointment should be moved or cancelled. Due to high request, <span style=\"text-decoration: underline;\">in\u00a0case of no-show the account will be <strong>suspended.<\/strong><\/span><\/p>\n<p>New appointments are added on Thursdays at 5pm local time. The appointment will be after <strong>two weeks<\/strong>. Cancelled slots will be immediately offered back, therefore we suggest to frequently check the availability.<\/p>\n<p style=\"text-align: justify;\"><strong>AT THE APPOINTMENT<\/strong><\/p>\n<p>At the appointment the <span style=\"text-decoration: underline;\">applicant<\/span> needs to present all the <span style=\"text-decoration: underline;\">correct and complete<\/span> documentation as requested. Applications with incomplete documentation will be <strong>rejected<\/strong>.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>This Consulate will ask for additional documentation if needed.<\/strong><\/span><\/p>\n<p>The documentation will NOT be returned to the applicant.<\/p>\n<p>The competent office is <a href=\"mailto:cittadinanza.houston@esteri.it\">cittadinanza.houston@esteri.it<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Reacquisition, if granted, takes effect from the day after the statement of intention is submitted and accepted, and it is\u00a0<strong>NOT<\/strong>\u00a0retroactive.<\/p>\n<p style=\"text-align: justify;\">Please note that transmission of Italian citizenship is governed by the current regulations set forth by Law 91\/1992 as amended by Decree 36\/2025, signed into Law 74\/2025. In particular, reacquisition of Italian citizenship\u00a0<strong>NO LONGER<\/strong>\u00a0grants automatic citizenship to any minor children who live with the applicant. In order to acquire Italian citizenship, pursuant to art.14 Law 91\/1992, minor children living with the applicant who has reacquired Italian citizenship, must have been residing in Italy for a minimum of two consecutive years at the time of their parent\u2019s reacquisition (or since birth if younger than 2yo).<\/p>\n<p style=\"text-align: justify;\">The parent who reacquires Italian citizenship is no longer an Italian citizen by birth and therefore cannot submit a statement of intent for their minor children.<\/p>\n","protected":false},"excerpt":{"rendered":"The changes and amendments in regulations introduced by D.L. 36\/2025, signed into Law 74\/2025, allows former Italian citizens \u2014 including those residing abroad \u2014 to reacquire Italian citizenship by submitting a formal declaration of reacquisition.
