Public will

Among the activities of the notary’s office at a Consulate is the drafting of some deeds concerning declarations of last will of subjects who are abroad.
The public will is the testator’s declaration of will made to an official delegated to notary functions in the presence of two witnesses and drawn up in writing.
In the secret will, on the other hand, the functions of the Notary Office are limited to the formal receipt of the deed (the content of which remains secret) and its deposit in the Office.
Lastly, the holographic will does not need to be drawn up by an official of the notary’s office and can be deposited anywhere and with anyone. Usually it is filed with the notary’s office in order to avoid the possibility of its loss and to ensure its immediate publication on the death of the testator.
